1. Who are we?
The company PROBIKESHOP (hereinafter "we", "our", "us"), a simplified single-shareholder company (S.A.S.U.) with a share capital of €350,000, registered with the Lyon Trade and Companies Register under number 983 316 951, with its registered office at 52 quai Rambaud, 69002 Lyon 2ÈME, is the data controller for the data collected in connection with use of the Site.
2. What data do we collect?
When using the Site, some of the information that may be requested from you is mandatory. Mandatory data fields are indicated by an asterisk or other sign; all other data is optional.
Failure to provide mandatory information means it will not be possible to access the Site's services.
2.1 Placing orders
When making a purchase, you will be asked for your payment details and postal address.
Following your purchases, we will process information relating to the monitoring of the commercial relationship: transaction number, products purchased, services or subscriptions taken out, services covered by the order and invoice, quantity, amount, frequency, date and amount of the order and invoice, invoice due date, delivery conditions, purchase and service history. In the context of conversations with our customer service team, we may record the conversation with our advisers. We may also collect your reviews on products and services.
2.2 Contact form
You may send us general enquiries via the contact form. In this form, we ask for your name, a valid email address, as well as the subject and content of your question.
We need this information in order to be able to respond to your enquiry.
If you wish, you may also provide us with an order number or your phone number.
2.3 Newsletter and SMS
During the checkout process, you may subscribe to our email and/or SMS mailing list to receive exclusive offers, deals and tips by signing up to our mailing list either during the creation of your customer account. You may also subscribe by providing us with your email address via the sign-up form available in the footer throughout the site.
3. What information do we receive from third parties?
Social media: when you interact with us or with our content via social media, or when you use a social media feature integrated into the Site, we receive information from your interaction with that content (for example, information you have agreed to share, basic profile information, or content viewed and information about adverts that were shown to you or on which you clicked). By interacting with our social media, you consent to our use of data from those networks in accordance with this Privacy Policy. To find out more about how information from a third-party social network is obtained by Probikeshop, or to refuse the sharing of said information, we invite you to visit the website of the relevant third-party social network.

5. To which categories of recipients is data disclosed?
Your personal data is shared with the following persons, departments and organisations, each in respect of what concerns them:
- to authorised personnel in the following departments: sales, accounting, marketing and IT;
- to the company Probikeshop, in particular to ensure the dispatch of goods and the administrative management of the business
- to the company Rebloch'log in the context of logistics activities.
- to the providers and subcontractors mandated by Probikeshop to assist it in the management of:
- the Site (hosting, video integration)
- its commercial activities (emailing, review collection, customer relationship management, payment, dispatch of goods (couriers/parcel relay points)). Please note that certain payment partners (Oney) collect your personal data directly
- its day-to-day activities (chartered accountant, advisory services).
- to the acquirer of our company in the event of an acquisition or a change of control;
Personal data may be disclosed to a third party if Probikeshop is required to do so under a law or regulatory provision, a court order, or if such disclosure is necessary in the context of an investigation or proceedings on French territory or abroad, or is necessary to recover unpaid debts, investigate, prevent or take measures regarding illegal activities or alleged fraud.
We use Review Collect, a review management tool by REVCOL TECHNOLOGY LLC, to collect your feedback after purchase (by email, SMS or WhatsApp) and to allow you to rate our services on Trustpilot.
Your data (name, email, phone number, order date and number) is processed on the basis of our legitimate interest (Art. 6(1)(f) GDPR) and automatically deleted 2 months after your purchase. It is stored in the EU/EEA and is not transferred outside that area.

6. Where is your personal data processed?
Your data is hosted within the European Union.
However, some of our service providers process your data in the United States, where data protection and privacy regulations do not offer the same level of protection as in other parts of the world, such as the European Union. When data is transferred outside the European Economic Area to a country that does not benefit from an adequacy decision by the European Commission, your data is adequately protected by standard contractual clauses approved by the European Commission or by any other mechanism recognised by applicable legislation. A copy of the transfer mechanism can be provided to you upon request.
7. How long do we retain your data?
Data necessary for the performance of a contract is retained for the duration of the contractual relationship. It is then kept in intermediate archiving in order to meet our various legal obligations, particularly in relation to accounting or tax matters, but also to preserve any useful evidence in the event of a dispute, within the limits of the various applicable limitation periods depending on the purposes described above.
Data relating to your account on the Site (identity, electronic contact details) will be retained until your account is deleted by writing to us at privacy@probikeshop.com, or after a period of two years in the event of inactivity and after you have been notified.
Data relating to the management of transactions is retained in archived form for a period of 5 years for evidential purposes.
Accounting documents and records are retained for 10 years as accounting evidence.
Data collected via the contact form is deleted once the enquiry you submitted has been processed, unless we are required to retain it for longer due to a legal obligation. It will then be archived for evidential purposes for 5 years.
Personal data used for commercial prospecting purposes is retained, for customers, for a period of 3 years from the end of the contractual relationship, or, for prospects, for a period of three years from the date of collection or the last contact with the prospect, unless you object.
Recordings of conversations with our customer service team are destroyed 1 month after the call.
We also record your objection to receiving commercial solicitations for 3 years so that we can honour your request in the future.
8. What are your rights regarding your personal data?
Right of access
you may ask us for access to all or part of your personal data and to be informed of the conditions under which it is processed.
Right to rectification
you may ask us to rectify all or part of your data that is inaccurate or no longer up to date.
Right to erasure
you may ask us to erase all or part of your data, in particular where the data is no longer necessary for the purposes for which it was collected.
Right to object
You may object at any time to the processing of your data that is necessary for the purposes of the legitimate interests we pursue. We draw your attention to the fact that despite your request, we may be required to continue the processing if there are legitimate or compelling grounds justifying the processing, or for the establishment, exercise or defence of legal claims.
Right to restriction
you may ask for your data to be processed in a restricted manner (no processing is possible other than storage) in the following cases:
- for the period required to verify the accuracy of your Data following a dispute raised by you regarding its accuracy
- you consider the processing to be unlawful and request a restriction on the use of the data instead of erasure
- we no longer need to process your data but it is still needed by you for the establishment, exercise or defence of your rights
- you have objected to the processing of your data and wish to restrict its use while verification is carried out as to whether the legitimate interests we pursue justify continuing the processing.
Right to data portability
- You may request (i) to receive your data in a structured, commonly used and machine-readable format, (ii) that your data be exported to a third party where you have consented to the collection of your data or where your data was collected in the context of the performance of a contract. This is not the case in the present situation.
Right to withdraw consent
Where processing is based on consent, it may be withdrawn at any time.
Right to issue instructions regarding the fate of your data after death
You have the right to give us instructions regarding what happens to your data after your death.
To exercise your rights, you may contact us by writing to privacy@probikeshop.com and providing your surname, first name, email address and postal address.
You also have the right to lodge a complaint with the competent personal data protection authority — in France, the CNIL.
Unsubscribing from the newsletter and SMS
You may choose to stop receiving our newsletter at any time by using the unsubscribe link included in each message or by logging into your customer account. You may also inform us of your wish to unsubscribe by email at privacy@probikeshop.com.
To opt out of receiving SMS messages, simply reply "STOP" to one of our messages.

10. Amendment to the privacy policy
We may revise or supplement this Privacy Policy, in particular to take into account new purposes or changes in legislation. Such changes will take effect from the date of their publication. We will inform you of the changes made by means of a notification message displayed on the Site or by any other means of communication. We encourage you to periodically check and re-read this Policy to stay informed of its latest version.
